Borough Council Establishes Codes Appeals Board
Borough had previously shared a joint board with East Whiteland and Easttown.
Malvern Borough Council voted last week to establish a board of appeals for code issues in the borough.
Borough manager Sandy Kelley explained in an email that the board will hear appeals on building, plumbing and HVAC codes:
For instance, if someone doesn’t want to “sprinkler” a building, but the Codes Officer says they must “sprinkle”, the applicant could appeal that decision to the Appeals Board.
The borough had previously had a joint appeals board with East Whiteland and Easttown townships. A recent Pennsylvania court decision required the joint boards to split up unless they enforce their codes in a uniform manner.
The new board will consist of the same five members from the joint board, including the East Whiteland and Easttown residents. According to Kelley, appeals are very rare.
