District Court Wrap: Cadillac Crash, Rx Fraud

A rundown of East Whiteland, Willistown and Malvern criminal cases in District Court 15-2-5.

The following cases came before Judge Darlington in District Court 15-2-5 on Wednesday, Dec. 7.

Two no-shows

Earl Eden, 62, of Avondale, did not appear in court, despite being on the docket twice. He faces 28 counts of harassment in Willistown and a first-time DUI in East Whiteland. Eden checked into Paoli Hospital at 9:30 a.m. Wednesday morning. The officers of the court noted Eden's propensity to visit the hospital on court days.

Caitlyn Tucker, 28, of Devon, was another no-show. A pharmacist testified that Tucker had tried to fill a fraudulent prescription Sept. 14 at the Target in East Whiteland. Sgt. Louis Marcelli of the East Whiteland Police said he'd talked with Tucker, who admitted the fraud. The hearing proceeded against the defendant in absentia, and will proceed to trial. Judge Darlington issued a warrant for her failure to appear.

Malvern resident Thomas Aubry, 41, appeared in court for charges of harassment, terroristic threats and misdemeanor weapons charges filed Oct. 27. His accuser was in premature labor and did not appear. Sgt. Marcelli confirmed, "She was pregnant at the time of the incident." Judge Darlington set $3,000 unsecured bail and a new hearing date.

Thomas Stone, 55, of Newtown Square appeared on charges of Aggravated Assault by Vehicle While DUI, a felony. After hearing from the victim and Willistown Police Officer Bob Will, Judge Darlington ordered $10,000 unsecured bail. The victim testified that on Sept. 14 she was turning left from West Chester Pike onto Route 926, with a green arrow, when a Cadillac smashed into her vehicle. She identified Stone as the man she saw standing next to the Cadillac after she regained consciousness and before she was airlifted to Paoli Hospital with hip and back injuries. Officer Will testified that a glass pipe was recovered from the vehicle and lab reports confirm the presence of cocaine, valium and other drugs in Stone's blood on the day of the accident.

Clarence Hughes, 54, of Malvern, appeared on charges of terroristic threats against another tenant in Kingsbury condominiums. His accuser, a woman who lives a floor above him, testified that on Oct. 14 she asked him what he was doing standing on her floor at 10:30 p.m., and he screamed that it was none of her business. "He said he wouldn't hit a woman, but he knows people who would," Coleman said. When asked by the judge about his criminal history, Hughes said his memory wasn't very good. The judge read a list of charges from the 1980s that included harassment, assault and burglary, and Hughes said it sounded accurate. His bail was set at $5,000 unsecured.
